the deal, in plain words.
terms of service
these terms cover lucky, the mac app, the phone companion, the relay and this website. by downloading or using any of them you agree to them. if you don't, don't use lucky. the privacy page says what happens to your data and is part of these terms.
01what lucky is
lucky is an inbox for imessage and whatsapp on your mac. it shows the messages your mac already has, drafts a reply into the message box, keeps a sphere of the people you talk to, and offers intros, tips and reminders. it is early and free while we build it. we may change it, add to it, charge for parts of it later, or stop offering it, and we'll say so before any of that affects something you rely on.
02who can use it
you need to be at least 13, old enough to hold the messaging accounts lucky works with, and able to agree to these terms. if you use lucky for a company, you're telling us you can bind it.
03your mac, your accounts, your keys
lucky runs on your mac with permissions you grant it, uses messaging accounts that are yours, and talks to model providers with keys that are yours. that means:
- apple, whatsapp, openai, xai, linkdapi and google each have their own terms, and you're responsible for keeping to them. in particular, whatsapp's terms govern linked devices and unofficial clients; using lucky with whatsapp is your call and your risk, including the possibility of a warning or restriction on your whatsapp account.
- costs on your keys are yours. every model request lucky makes is billed by the provider to the key you entered. lucky tries to keep requests small, but you set the limits with the provider.
- keep your keys and your mac secure. anyone with your mac user account can open lucky and what it holds.
04your messages are yours
everything lucky reads, shows or drafts from your chats is your content, and the content of the people who wrote to you. we claim no rights in any of it. lucky keeps it on your mac and sends it only where the privacy page says, when you've turned that on.
you're responsible for what you send. lucky never sends a message on its own: a draft waits in the box until you press enter, and only what's in the box goes. read a draft before you send it, the way you'd read anything before you send it.
05drafts, tips and profiles are guesses
drafts, suggested replies, tips, reminders, moments, catch-ups, intros, profiles and search results are written by a model from your chats and public pages. they can be wrong, out of date, or miss the point. a profile may be of the wrong person with the same name. a reminder may be about something already done. none of it is advice of any kind, and you decide what to do with it.
06what you agree not to do
- use lucky to send spam, harass anyone, or send anything unlawful.
- use the profile features to build lists of people you don't actually talk to, or for any purpose beyond keeping up with your own contacts.
- use lucky to collect information about someone in a way that breaks the law where you or they live.
- interfere with the relay, probe it, flood it, or try to read frames that aren't yours.
- resell lucky or pass it off as yours.
07the licence
we give you a personal, non-exclusive, revocable licence to install and use lucky on macs and phones you control. lucky's own code, name and design stay ours. the app ships helper programs under their own open-source licences, and those licences govern those parts where they say so.
08the relay
the phone companion talks to your mac through a relay that forwards encrypted frames. we may run one for you; you may run your own and point lucky at it. a relay we run is offered as-is, may be rate-limited, and may be paused or moved. it is not a backup of anything: if it's down, your mac still has everything.
09no warranty
lucky is early software, provided as is and as available, without warranty of any kind, express or implied, including of merchantability, fitness for a particular purpose, or non-infringement. we don't promise it'll be uninterrupted, error-free, or that a draft will ever be right. where the law doesn't allow a warranty to be excluded, it's limited to the minimum the law allows.
10limits on our liability
to the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, a restricted messaging account, or charges on your api keys, arising from your use of lucky. our total liability for anything to do with lucky is capped at the greater of what you paid us for it in the past twelve months and fifty us dollars. some places don't allow some of these limits, so some may not apply to you.
11indemnity
if someone brings a claim against us because of how you used lucky, what you sent with it, or your breach of these terms, you'll cover our reasonable costs of dealing with it.
12ending things
you can stop any time: quit lucky, delete it, and delete its data folder as the privacy page describes. we can end your licence if you break these terms. sections 4, 5, 9, 10, 11 and 13 survive.
13governing law
these terms are governed by the laws of [your state or country], without regard to its conflict-of-law rules, and any dispute goes to the courts there. if any part of these terms can't be enforced, the rest still applies. these terms are the whole agreement about lucky between you and us; nothing else, spoken or written, changes them.
14changes to these terms
we'll update these terms as lucky grows. the date at the top will change, and for anything that matters we'll say so in the app's release notes before it takes effect. using lucky after a change means you accept it.
